Boyar & Miller, the law firm Wendy's had hired, never filed paperwork for a 2001 legalization program that allowed immigrants with employer sponsorship or an American spouse to apply for citizenship.

That is not why they are suing. They are suing because they paid out of their meagre wages to get into a program that would have legalized their status, only to have their payments lost, their jobs lost, and their chance to become legalized lost. Given that, they have every right to sue - not only Wendy's (which would have kept a watch on any other legal matter that truly concerned their own interests) but the law firm that bungled the filing. Given what has happened, it would only be fair to allow the immigrants to benefit from the program, despite having missed the filing deadline ... I do NOT blame immigrants, legal or illegal, for coming to this country. This country allows them to come in practice, no matter its theoretical opposition; it allows them to come because American businesses - and the American public - wish to exploit them w/o mercy. That's that, and to hell w/all the other nonsense that is spread around w/the trowel of the media circus. People don't want to pay more than they really have to pay for their this, that, and the other, so, nobody gives 2 shits that some Mexican or other non-American has to break his back for shit pay to provide what is wanted. That's the truth, no matter what anyone says.
