View Full Version : Is this illegal? Copyrighted pictures.

I've been meaning to draw some of the old Indian chiefs of America, but I'll be damned if I can find one that is open domain that I want to draw. Can I draw and do a re-creation of the pictures that I see as long as I don't try to sell them, can I put them online for display too? Can I do it as long as I give credit where credit where credit is due?

Yes and no.

You can do it, but you don't have to give them credit - that is simply a good gesture on your part.

Should technically ask for permission prior to posting. Especially in the case of photography...

You could however do a combined drawing... taking from multiple references. Then it doesn't infringe on any copyright. Be sure you give credit to your references though.

I wouldn't think you would need permission because it becomes your drawing, once you alter it. Can you just change the composition, so it doesn't look like an exact copy? (Just my opinion, not a legal opinion).

Not sure what you mean by "old" Indian chiefs, but are you sure they aren't public domain images or photographs? If you found them on a website, send an email. Some sites will claim copyright on material where they have no legal claim. Others may refer to the entire layout of the site rather than the individual images. Some may be willing to grant permission, or direct you, or forward your email to the individual who holds the copyright.
Generally you can draw anything you like. It's the sharing of your art that creates the legal problem. Since you intend to do both, either give more information, or keep searching through the public domain.

Go ahead and draw anything you want.

Unless you try to sell the pictures, make money off of drawing, or are rich - then expect to get sued. Or at least a cease-and-desist.

The point being if there's no money involved, there's no point in a copyright owner going after you. But giving credit where it's due is just plain common and moral sense.

Hmmm...I'd say that if drawing someone else's drawing, then that's a derivative work, which means you'd be violating their copyright...unless yours is so different that you've transformed it into your own work, in which case you own the copyright.

Of course, that only applies if you do a drawing based on their drawing. Any picture of an old Indian chief is probably in the public domain, which means if you did a rendition of that public domain photo, you're free to do whatever you want with it.
